What is a Mass Tort?

When negligence causes an injury, the injured party may decide to sue. If many people are injured similarly, this is a mass tort. A mass tort is a wrongful action affecting numerous people. Processing hundreds or thousands of individual lawsuits against the same party is time-consuming and often inefficient. Mass tort cases allow the court to streamline the process by combining plaintiffs who were harmed similarly. Multidistrict litigation (MDL) is often used to handle mass tort claims. MDL involves consolidating similar cases to the same federal court under one judge. MDLs will also include bellwether trials, also known as test cases. These trials give the plaintiffs and defendants an idea of how a jury might perceive the evidence and guide settlement discussions. Mass torts often fall into three categories: defective or dangerous products, defective medical devices or drugs, or toxic exposure. Even if a company or manufacturer wasn’t aware that their product was dangerous, they can still be held liable if a plaintiff can prove that they should’ve known of the risk.

Frequently asked questions

Your guide to understanding Mass Torts and our dedicated services.

What defines a mass tort?

Mass torts are legal actions where numerous plaintiffs come together against one or several defendants, usually companies, for harm caused by products or actions. These cases streamline the legal process and increase efficiency in handling similar claims.

How does a mass tort differ from a class action?
While both involve multiple plaintiffs, mass torts handle each plaintiff's case individually, acknowledging unique damages, whereas class actions treat the group as a single entity.
What are the steps to start a mass tort claim?

Begin by consulting with an intake specialist for a case evaluation. We'll guide you through the legal process, from filing your claim to potentially joining a multidistrict litigation (MDL).

What types of cases do you handle?

We handle a variety of mass tort cases, including those involving defective products, environmental toxins, pharmaceuticals, and medical devices.

How do I know if I'm eligible for a mass tort claim?
If you've suffered harm that mirrors the experiences of others from a similar cause, you might be eligible. Please feel free to contact us for a detailed assessment of your situation.
